What is commonly known as “burglary” is called “home invasion” under Michigan law. Home invasion is a felony in Michigan, and a felony conviction could have serious and lasting consequences on your life. Offenses

Home Invasion charges are separated by three tiers, which vary in degrees of punishment. First degree is the most serious, and third degree is less serious. First Degree:

  • Breaking and entering into a dwelling (or entering a dwelling without permission) with intent to commit a felony, larceny, or assault; AND
  • Committing a felony, larceny, or assault at any time; AND
  • Either armed with a dangerous weapon; or if another person is lawfully in the dwelling at the time of the breaking and entering.

Second Degree

  • Breaking and entering into a dwelling (or entering a dwelling without permission) with intent to commit a felony, larceny, or assault; AND
  • Committing a felony, larceny, or assault at any time;

Third Degree:

  • Breaking and entering into a dwelling (or entering a dwelling without permission) with intent to commit a misdemeanor in the dwelling;
  • Breaking and entering a dwelling and actually committing a misdemeanor while you are present in, entering, or exiting the building
  • Breaking and entering a dwelling and in doing so violating a protection order, parole condition, probation condition, or a bond condition

Penalties

First degree: Felony

  • Up to 20 years in prison
  • Fines up to $5,000

Second degree: Felony

  • Up to 15 years in prison
  • Fines up to $3,000

Third degree: Felony

  • Up to 5 years in prison
  • Fines up to $2,000
